AB 1649: Pupil Attendance: residency requirements (2003)

Summary

AB 1649 (2003) amends Education Code § 48207 so that a pupil in a skilled nursing facility that requires special education instruction is not deemed a resident of the school district in which the hospital is located. AB 1649 instead shifts the cost of the special education services to the district where the child’s parent or guardian resides. Previous law unduly burdened and effectively punished school districts that had the “misfortune” to have such a skilled nursing facility located within their boundaries.
