SB 1073: Special education: out of home care (2005)

Summary

SB 1073 would have provided a technical clean-up to statutes governing payments for exceptional costs that are made in support of students with severe disabilities who reside in skilled nursing facilities.  Because of a drafting error, school districts that provide special education services to these students may only be reimbursed if the referral to the hospital, when made due to medical conditions rather than as a result of their IEP, is made by the Department of Developmental Services.  This unintentionally precludes funding for approximately 170 students who are referred to the DDS-run hospitals by private doctors.

The Department of Finance, Legislative Analyst, and Departments of Education and of Developmental Services have all concurred with legislative budget personnel that the error is technical in nature and that these students were intended to be funded.
