SB 1739: Oil Spill Contingency Plan (2008)

Summary

Senate Bill 1739 (2008):

  • Ensures that training and drills on oil spill contingency plans are not limited to vessels, but also apply to marine facilities, small marine fueling facilities, and mobile transfer units;
  • Requires, rather than authorizes, oil spill response organizations (OSROs) to demonstrate that required response resources can be deployed for an oil spill;
  • Requires, rather than authorizes, unannounced drills before being granted a renewal of a rating to respond to an oil spill – and prior to reinstatement of a revoked or suspended rating;
  • Clarifies that if an oil spill response or a federal unannounced drill is substituted for a state unannounced drill, that response or drill must have occurred in the past three years (which conforms to the three-year OSRO rating period); and
  • Provides for an independent oil spill drill monitor if the Office of Spill Prevention and Response administrator, U.S. Coast Guard, or other qualified public agency cannot attend a drill held outside the state.

After this bill passed the Legislature, Senator Simitian sent a letter to the Governor urging his signature on this bill.
